What Is an Inheritance Power of Attorney?
An Inheritance Power of Attorney is an official legal document, notarized by a notary public, through which a legal heir appoints a trusted person to handle the legal and administrative procedures related to the estate of a deceased person.
It usually authorizes the agent to represent heirs before courts and government authorities, obtain the succession certificate, receive heirs’ shares, and complete the procedures required to distribute assets according to the applicable legal shares.
This POA is especially useful when there are multiple heirs or heirs living outside the UAE. It allows one agent to complete the procedures without requiring every heir to attend in person.
What Can the Inheritance Agent Do?
- Represent heirs before Dubai Courts and judicial authorities
- Apply for and collect the succession certificate or inheritance certificate
- Follow up on estate inventory and distribution procedures
- Deal with Dubai Land Department for inherited real estate transfers
- Coordinate with banks, DEWA and government authorities
- Receive heirs’ shares from funds and assets
- Appoint lawyers and file necessary claims to protect heirs’ rights
Important Difference: A will determines how assets should be distributed after death. An Inheritance POA is used after death to manage and execute inheritance procedures. For estate planning, see our Dubai Courts Will service.
